1. Overview of Paper Assignment

I have divided the class into seven teams. Each team will research a case that the U.S. Supreme Court has agreed to decide—and produce a short (10 minute) in-class presentation and a paper (limited to 20 pages) on that case.

2. Contents

Your paper should contain:

  • general introduction, a section containing background information on the case (including a summary of the facts and of the lower court decisions).
  • a cert account, a section explaining why you think the Court decided to hear the case;
  • a decision-making account, a section explaining/predicting how the Court will decide the case. It should draw on legal, political, and strategic accounts of decision making.
  • individual justices, a section predicting how the individual justices will vote, and explaining the basis for your predictions.

3. Misc.

  • In researching and writing your paper, you are free to draw on any sources you so desire—EXCEPT the Court's decision, should it come down before the paper is due.
  • The citation style you use matters not to me as long as it is consistent throughout the paper.
